Terms of Service

These terms of service (hereinafter referred to as "these Terms") set forth the conditions for the use of services (hereinafter referred to as "the Service") provided on this website by the operator of QCoder (hereinafter referred to as "the Operator"). All registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.

Application

1. These Terms apply to all relationships related to the use of the Service between Users and the Operator.
2. In addition to these Terms, the Operator may establish various provisions (hereinafter referred to as "Individual Provisions") regarding the use of the Service. Regardless of their name, these Individual Provisions shall constitute a part of these Terms.
3. In the event of any inconsistency between the provisions of these Terms and the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.

User Registration

1. To use the Service, an applicant shall apply for registration following the method prescribed by the Operator, and the registration shall be completed upon the Operator's approval.
2. The Operator may not approve an application for registration if it determines that the applicant has any of the following reasons, and is not obligated to disclose the reasons:
   1. False information was provided at the time of the registration application.
   2. The applicant has previously violated these Terms.
   3. Other reasons deemed inappropriate for registration by the Operator.

Management of User ID and Password

1. Users shall appropriately manage their email address and password used for login authentication at their own responsibility.
2. Users shall not transfer, lend, or share their login authentication information with any third party under any circumstances. The Operator considers the use of the Service by a combination of registered email address and password as the use by the registered User.
3. The Operator shall not be liable for any damages resulting from the use of login authentication information by a third party, except in cases of intentional or gross negligence by the Operator.

Prohibited Actions

Users shall not engage in the following actions while using the Service:

1. Acts that violate laws or public order and morals
2. Acts related to criminal activities
3. Acts that infringe the copyrights, trademark rights, or other intellectual property rights contained in the Service
4. Acts that destroy or interfere with the functionality of the Operator's or other users' servers or networks
5. Commercial use of information obtained through the Service
6. Acts that may interfere with the operation of the Operator's services
7. Unauthorized access or attempts to make unauthorized access
8. Collection or accumulation of personal information of other users
9. Use of the Service for fraudulent purposes
10. Actions that cause disadvantage, damage, or discomfort to other users or third parties
11. Impersonation of other users
12. Advertising, solicitation, or business activities on the Service without the Operator's permission
13. Acts for the purpose of meeting unacquainted individuals of the opposite sex
14. Directly or indirectly providing benefits to antisocial forces in connection with the Operator's services
15. Other actions deemed inappropriate by the Operator

Intellectual Property Rights

1. Ownership and copyright of programs posted on the Service belong to the user who created the program.
2. All rights (ownership, intellectual property rights, portrait rights, publicity rights, etc.) regarding the text, images, programs, and other data that constitute the Service, except for those created by the users themselves, belong to the Operator or third parties holding the relevant rights.
3. Users permit the Operator to publish and distribute (including public transmission and making available) the user's content on this website.

Suspension of Service Provision

The Operator may suspend or interrupt the provision of the Service, in whole or in part, without prior notice to users if it determines any of the following reasons:

1. Maintenance, inspection, or updating of the computer system related to the Service
2. Provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, or natural disasters
3. Computer or communication line failures
4. Other reasons deemed difficult for the provision of the Service by the Operator

The Operator shall not be liable for any disadvantages or damages suffered by users or third parties due to the suspension or interruption of the Service.

Usage Restrictions and Registration Cancellation

The Operator may restrict the use of the Service, in whole or in part, or cancel the registration of a user without prior notice if the user falls under any of the following:

1. Violation of any provision of these Terms
2. Engaging in fraudulent acts recognized by the Operator
3. Discovery of false information in the registration details
4. No response to communications from the Operator for a certain period
5. No use of the Service for a certain period since the last use
6. Other reasons deemed inappropriate for the use of the Service by the Operator

The Operator shall not be liable for any damages incurred by users due to actions taken by the Operator under this Article.

Account Deletion

Users may delete their accounts from the Service by following the procedures prescribed by the Operator.

Disclaimer and Warranty Disclaimer

1. The Operator does not warrant that the Service is free from defects in fact or law (including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc., errors or bugs, rights infringement, etc.), either explicitly or implicitly.
2. The Operator shall not be liable for any damages incurred by users due to the Service, except in cases of intentional or gross negligence by the Operator.
3. Even in cases where the Operator is liable under the preceding paragraph, the Operator shall not be liable for special damages resulting from the Operator's breach of contract or tort due to the Operator's negligence (excluding gross negligence), even if the Operator or the user foresaw or could have foreseen such damages.
4. The Operator shall not be responsible for transactions, communications, or disputes arising between users and other users or third parties in connection with the Service.

Changes to Service Content

The Operator may change, add, or discontinue the content of the Service, and users shall consent to this.

Amendments to Terms

The Operator may amend these Terms without obtaining individual consent from users in the following cases:

1. When the amendment to these Terms is in the general interest of users.
2. When the amendment to these Terms does not contradict the purpose of the service usage contract and is reasonable in light of the necessity of the amendment, the appropriateness of the amended content, and other circumstances related to the amendment.

Handling of Personal Information

The Operator shall appropriately handle personal information obtained through the use of the Service in accordance with the Operator's Privacy Policy.

Notices and Communications

Notices or communications between users and the Operator shall be made following the method prescribed by the Operator. The Operator considers the currently registered contact information as valid unless a change notification is submitted in the manner prescribed by the Operator, and will send notices or communications to such contact information. These notices or communications shall be deemed to have reached the users at the time of dispatch.

Prohibition of Transfer of Rights and Obligations

Users may not transfer or pledge their contractual position or rights or obligations under these Terms to any third party without the prior written consent of the Operator.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the courts having jurisdiction over the location of the Operator.
